The Anonymous Homily in the Glagolita Clozianus and the Earliest Slavonic Juridical Texts

Summary: 

The article discusses the question of the place of the Anonymous Homily in the Medieval Slavonic juridical literature. The text of the homily is attested in the Glagolita Clozianus and is considered to be an original work of St. Methodius. In this survey it is viewed in the context of Byzantine legal tradition, which reverberated in the Slavonic tradition, e.g. in the Zakon sudnyj liudem, in some „mirrors for princes“, in later Slavonic legal collection such as Knigi zakonni and Merilo Pravednoe. In this context it seems that the Anonymous Homily cannot be seen as a law or as part of Zakon sudnyj liudem. In its function, structure, stylistics, and in regard with the composition of the miscellany, the Anonymous Homily is a typical moralizing text (pouchenie). Nevertheless, it should not be excluded from the juridical literature. According to the latest scholarly views the Byzantine, and respectively the Slavonic legal systems should be considered as an entity – didactic and juridical, translated and original. In this sense a text such as the Anonymous Homily, focused on the questions of the reign, of its roots and nature, is indisputably related to law and to juridical texts.
